IIOJK court quashes PSA detention of 65-year-old man in Doda

Jammu: Indian authorities face rebuke over arbitrary use of draconian detention laws in Indian illegally occupied Jammu and Kashmir.

The IIOJK High Court quashed detention of a 65-year-old elderly man in Doda on Sunday. The ruling exposed misuse of draconian Public Safety Act (PSA) in occupied territory.

Court said constitutional safeguards were violated to suppress the Kashmiri resident.

Judge M A Chowdhary pronounced judgment allowing habeas corpus plea. Petitioner Din Mohd Wani, resident of Shuryan in Doda district, was detained. His son Shahraz Hussain Wani filed petition against detention order.

District Magistrate, Doda, had issued order No. PSA/02 of 2026 on April 28.Court directed Wani be released forthwith if not required otherwise.

Referring to earlier judgments, High Court reiterated important legal principle. Ordinary criminal allegations cannot justify detention without public order threat.

Public Safety Act (PSA) is termed as lawless law by human rights groups. It allows detention without trial for up to two years in occupied Jammu and Kashmir. Thousands of Kashmiris have been booked under PSA since 1990 for political reasons.
