NIA court rejects bail plea of detained freedom activist in Jammu
Jammu: In Indian illgally occupied Jammu and Kashmir, a Special NIA Court in Jammu has rejected the regular bail application of detained freedom activist Tafazul Hussain Parimoo in a case registered under the black law, the Unlawful Activities (Prevention) Act (UAPA).
According to Kashmir Media Service, Parimoo has remained in custody since October 2020. During the hearing, his counsel argued that no arms had been recovered from him and pointed out that only 23 of nearly 150 prosecution witnesses had been examined despite his prolonged detention.
The National Investigation Agency (NIA), opposing the bail plea, alleged that Parimoo was an active overground worker. The court observed that charges under the UAPA, the Indian Penal Code (IPC) and the Arms Act had already been framed.
The court held that the principle of “bail is the rule, jail the exception” does not apply with the same force in cases under the UAPA and expressed concern that the accused could “influence” witnesses or tamper with evidence if released.
It subsequently dismissed the bail application, stating that national security could not be compromised.
