Pakistan’s government alleged that Jadhav was a serving officer in the Indian Navy, operating under the alias Hussain Mubarak Patel, and accused him of conducting espionage and sabotage activities on behalf of India’s Research and Analysis Wing (RAW).

In contrast, India acknowledged Jadhav as a retired naval officer but firmly denied any current association with him, asserting that he had been abducted from Iran and unlawfully transferred to Pakistan.

Following his arrest, Jadhav was tried in a Pakistani military court. In April 2017, he was sentenced to death on charges of espionage and activities against the state. This verdict was met with strong objections from India, which questioned the fairness and transparency of the trial proceedings.

In response to the death sentence, India approached the International Court of Justice (ICJ) in May 2017, seeking a stay on Jadhav’s execution and alleging violations of the Vienna Convention on Consular Relations by Pakistan. The ICJ intervened, ordering Pakistan to stay the execution pending a final judgment. In its July 2019 verdict, the ICJ directed Pakistan to provide consular access to Jadhav and to review and reconsider his conviction and sentence.

As of March 2025, Kulbhushan Jadhav remains in Pakistani custody. Despite the ICJ’s directives, there has been limited progress on the review of his case, and consular access has been a contentious issue between the two countries. The case continues to be a significant point of tension in India-Pakistan relations, symbolizing the broader geopolitical and diplomatic challenges in the region.

(Courtesy: MASHRIQ VIBE)

March 3, 2025, marks the ninth anniversary of the arrest of Kulbhushan Jadhav, an Indian national detained by Pakistani authorities in Balochistan on charges of espionage and involvement in subversive activities.
