On February 22, 2024, Chinese Foreign Ministry legal adviser Ma Xinmin stated before the ICJ that armed struggle under illegal occupation is distinct from terrorism, emphasizing that all parties must nonetheless comply with international humanitarian law.<\/p>\n<p>They further noted that the abrogation of Articles 370 and 35A in August 2019 exposed India\u2019s settler-colonial agenda, turning the territory into an open-air prison. State repression, including arbitrary arrests, media crackdowns, and mass demolitions, has become the norm in IOJK, they said.<\/p>\n<p>They said that the resistance movement in IOJK is a direct response to decades of systemic oppression, widespread human rights abuses, and the international community&#8217;s continued indifference. Rather than addressing the legitimate demands of the Kashmiri people, the Indian government has attempted to equate these demands with terrorism \u2014 a false narrative aimed at justifying its repressive actions and delegitimizing Kashmiri aspirations.<\/p>\n<p>The analysts pointed out that the failure to investigate incidents such as the Pahalgam episode, and the widespread destruction of homes on mere suspicion without due process, exemplifies the culture of impunity that prevails under Indian administration. The lack of accountability and transparency highlight the urgent need for international oversight.<\/p>\n<p>They urged the United Nations, the European Union, the Organisation of Islamic Cooperation (OIC), and other powers to send fact-finding missions to assess the ground reality and support a UN-supervised plebiscite to allow the people of Jammu and Kashmir to exercise their right to self-determination, as promised in international law.<\/p>\n<p>The international community, they concluded, must act now to uphold justice and legal commitments to the Kashmiri people.<\/p>\n<p>Meanwhile, Pakistani Foreign Office Spokesperson Shafqat Ali Khan, during a press briefing, emphasized that Pakistan has consistently remained at the forefront of the global fight against terrorism, playing a pivotal role in promoting international peace through decisive counter-terrorism measures. He noted that it was Pakistan that successfully apprehended Sharifullah, the mastermind behind the deadly Abbey Gate bombing.<\/p>\n<p>He further stated that India is attempting to divert the international community\u2019s attention from the grave human rights violations being committed against unarmed civilians in IOJK. India has a well-documented history of spreading anti-Pakistan propaganda to deflect from its internal abuses, he maintained.<\/p>\n<p>Pakistan, he said, has made unmatched sacrifices in the war against terrorism. In light of this, the international community must pursue objective and non-discriminatory policies, and work collectively to address this global menace.
