This is unconstitutional and deeply unfortunate,\u201d she stated.<\/p>\n<p>The Bill seeks to provide for the removal of the prime minister, chief ministers and ministers at both the Centre and states, who are detained for at least 30 days on charges of corruption or serious criminal offences.<\/p>\n<p>AIMIM MP Asaduddin Owaisi said the amendment was unconstitutional and would push India towards a \u201cpolice state.\u201d He added, \u201cWho will have the authority to arrest a prime minister? This is nothing but a tool for political misuse. The BJP is forgetting that power is not permanent.\u201d<\/p>\n<p>Congress leader Gaurav Gogoi alleged that Home Minister Amit Shah introduced the Bill to distract attention from Rahul Gandhi\u2019s ongoing \u2018Voter Adhikar Yatra.\u2019 \u201cFirst the CSDS\u2013BJP IT cell drama, now these Bills. The government wants to divert the public mood, but the winds of change are already sweeping Bihar,\u201d he said.<\/p>\n<p>Another Congress leader, KC Venugopal, wrote on X that the Bill was designed to target opposition governments and intimidate allies. \u201cWhen \u2018vote-chori\u2019 is on everyone\u2019s minds, Rahul Gandhi\u2019s yatra is getting unparalleled support, opposition governments need to be targeted, allies like Chandrababu Naidu and Nitish Kumar need to be threatened\u2026the Home Minister brings this dangerous Bill that strikes at the heart of the Constitutional principles of federalism.\u201d<\/p>\n<p>Observers note that the recent spate of Bills spearheaded by Amit Shah during the monsoon session have raised fundamental concerns about India\u2019s constitutional framework. The opposition argues that these moves erode the presumption of innocence until proven guilty, grant quasi-judicial powers to the executive, and open the door for arbitrary disqualification of elected representatives.<\/p>\n<p>Critics further warned that the Bills undermine the separation of powers, risk being abused as political weapons to silence dissent, and threaten the democratic mandate entrusted by the electorate.<\/p>\n<p>Adding to the controversy is the Jammu and Kashmir Bill, which centralizes sweeping powers in the office of the unelected Governor, sidelining elected representatives of the territory.<\/p>\n<p>Leaders from occupied Jammu and Kashmir also voiced alarm. Congress leader Ghulam Ahmad Mir said the people of Kashmir were expecting restoration of statehood, not \u201canother attack on democracy.\u201d He warned that provisions forcing automatic resignations after 30 days in custody amounted to \u201canother wound on democracy\u201d and accused the BJP of systematically downgrading states and UTs. The CPI-M denounced the bills as \u201canti-democratic,\u201d describing them as an attempt to bypass judicial scrutiny and weaponize arrests against opposition-ruled states, calling for a united resistance. Senior Congress leader Tariq Hameed Karra termed the move \u201cautocratic and alarming for federalism,\u201d saying the government was operating out of \u201cfear and distrust,\u201d and warned that today\u2019s attacks on Kashmir could set a precedent for other states tomorrow.
