This measure has effectively turned the Lieutenant Governor of Indian illegally occupied Jammu and Kashmir (IIOJK) into a \u201csuperpower,\u201d while rendering elected representatives powerless. The move is designed to give New Delhi full control over Kashmir\u2019s political affairs without any intervention from local voices.<\/p>\n<p>Observers point out that the LG in IIOJK already holds sweeping authority, controlling agencies such as the NIA, SIA, CID, police, and anti-corruption bodies. This means that fabricated cases can easily be framed against Ministers or Chief Ministers to remove them from office. Analysts warn that any leader opposing New Delhi\u2019s agenda can be ousted at will through these agencies and the unchecked powers vested in the LG. Critics argue that the new law has nothing to do with transparency but is instead a political weapon to tighten India\u2019s colonial grip on Kashmir.<\/p>\n<p>Under the Representation of the People Act, 1951 (RP Act), any person convicted in a criminal case and sentenced to not less than two years in jail is disqualified from being a member of Parliament or State legislature for the duration of their sentence and six years thereafter. However, this disqualification does not apply to holding ministerial office. Section 8(4) of the RP Act earlier provided that such disqualification would not apply if an appeal was filed, but the Supreme Court struck it down as unconstitutional in the Lily Thomas case (2013).<\/p>\n<p>In 2016, the Election Commission recommended amending the RP Act to bar persons against whom charges are framed for offences punishable with at least five years in prison from contesting elections. Yet, the Indian government chose to apply a harsher measure only in IIOJK, effectively targeting its leadership.<\/p>\n<p>Critics further argue that the new bill undermines parliamentary democracy by enabling elected representatives to be removed through mere police action, even before trial proceedings begin. It hands the Centre sweeping powers to initiate vindictive action against Ministers in opposition-ruled States and, in the case of IIOJK, ensures complete central dominance.<\/p>\n<p>Analysts say that while criminalisation of politics is a deep-rooted malaise in India\u2014with 46% of MPs and 45% of MLAs facing criminal cases, according to the Association of Democratic Reforms\u2014the new legislation does not address this issue.
