{"id":183707,"date":"2025-09-16T21:03:48","date_gmt":"2025-09-16T16:03:48","guid":{"rendered":"https:\/\/kmsnews.org\/kms\/?p=183707"},"modified":"2025-09-16T21:03:48","modified_gmt":"2025-09-16T16:03:48","slug":"aimplb-rejects-indian-scs-interim-order-on-waqf-amendment-act-as-incomplete","status":"publish","type":"post","link":"https:\/\/kmsnews.org\/kms\/2025\/09\/16\/aimplb-rejects-indian-scs-interim-order-on-waqf-amendment-act-as-incomplete.html","title":{"rendered":"AIMPLB rejects Indian SC\u2019s interim order on Waqf (Amendment) Act as incomplete"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-183709\" src=\"https:\/\/kmsnews.org\/kms\/assests\/2025\/09\/waqf.jpg\" alt=\"\" width=\"570\" height=\"379\" srcset=\"https:\/\/kmsnews.org\/kms\/assests\/2025\/09\/waqf.jpg 570w, https:\/\/kmsnews.org\/kms\/assests\/2025\/09\/waqf-331x220.jpg 331w\" sizes=\"auto, (max-width: 570px) 100vw, 570px\" \/>New Delhi: The All India Muslim Personal Law Board (AIMPLB) has voiced disappointment over the Indian Supreme Court\u2019s interim judgment on the Waqf (Amendment) Act 2025, calling the order incomplete and unsatisfactory.<\/p>\n<p>According to Kashmir Media Service, AIMPLB leaders, Syed Qasim Rasool Ilyas and Maulana Mohammed Fazlurrahim Mujaddidi, addressing media persons at Press Club of India in Delhi said that although the apex court had stayed some controversial provisions of the law, it failed to address broader constitutional concerns raised by Muslims and other citizens.<\/p>\n<p>\u201cWhile the Court has granted partial relief, it has not touched the larger constitutional issues, which has left us disappointed,\u201d Dr. Ilyas remarked. He added that \u201cmany crucial provisions, which are arbitrary and harmful to the community, remain intact.\u201d<\/p>\n<p>Warning of possible misuse, Dr. Ilyas said, \u201cGiven the prejudiced manner in which government functionaries act, the provisions not stayed at this stage are bound to be abused.\u201d<\/p>\n<p>The interim order provided relief on several fronts, including protection of waqf property rights, curbing arbitrary powers of revenue officers, limiting non-Muslim representation on waqf boards, and suspending the rule that required proof of being a practicing Muslim for five years before creating a waqf.<\/p>\n<p>However, the AIMPLB said it remains deeply concerned about provisions such as the prospective de-recognition of \u2018Waqf by user\u2019 and the compulsory requirement of a waqf deed, which it argued run contrary to Islamic law.<\/p>\n<p>\u201cThe entire amendment is a deliberate move to weaken and seize waqf properties of Muslim community. We demand the complete repeal of the Waqf (Amendment) Act 2025 and restoration of the earlier law,\u201d Dr. Ilyas declared.<\/p>\n<p>He further announced that the Board\u2019s Save Waqf Campaign will intensify.
