{"id":184096,"date":"2025-09-23T09:30:07","date_gmt":"2025-09-23T04:30:07","guid":{"rendered":"https:\/\/kmsnews.org\/kms\/?p=184096"},"modified":"2025-09-23T09:30:07","modified_gmt":"2025-09-23T04:30:07","slug":"court-orders-fir-independent-probe-into-kathua-custodial-torture-case","status":"publish","type":"post","link":"https:\/\/kmsnews.org\/kms\/2025\/09\/23\/court-orders-fir-independent-probe-into-kathua-custodial-torture-case.html","title":{"rendered":"Court orders FIR, independent probe into Kathua custodial torture case"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-184097\" src=\"https:\/\/kmsnews.org\/kms\/assests\/2025\/09\/FIR.jpg\" alt=\"\" width=\"293\" height=\"172\" \/><\/p>\n<p>Srinagar: In Indian illegally occupied Jammu and Kashmir, the Chief Judicial Magistrate (CJM) Kathua, Ajay Kumar, has directed the Senior Superintendent of Police (SSP) Kathua to register a First Information Report (FIR) in connection with the custodial torture of two labourers from Punjab, India.<\/p>\n<p>According to Kashmir Media Service, the order came while hearing an application filed by the victims, Shukar Deen and Fareed Mohammad of Pathankot, who accused Basohli police officials of torturing them during a midnight raid at Atal Setu in June. The CJM ruled that the allegations involved cognisable offences and, under Supreme Court judgments, registration of an FIR was mandatory.<\/p>\n<p>The court further observed that preliminary inquiries were impermissible in custodial violence cases and that police claims of innocence could not be accepted without an impartial investigation.<\/p>\n<p>The CJM ordered that the investigation be handed over to an experienced and independent police officer. The SSP Kathua has been asked to submit an action-taken report to the court within one week.<\/p>\n<p>The matter had already reached the High Court of occupied Jammu and Kashmir, where a contempt petition filed by the victims led to issuance of notices against eleven police personnel, including the SDPO and SHO Basohli. The High Court took serious note of violations of Supreme Court guidelines, particularly the landmark DK Basu ruling on custodial safeguards.<\/p>\n<p>Human rights defenders in the territory have pointed out that custodial torture has become endemic under draconian laws in occupied Jammu and Kashmir, where impunity shields police and Indian forces personnel from accountability.
