Use of NSA against Aminul Haq was illegal, unconstitutional: HC

Guwahati: The Gauhati High Court of the Indian state of Assam has declared the illegal arrest of Aminul Haq Islam, a Muslim member of the state assembly, null and void and ordered his release.

According to Kashmir Media Service, the court in its judgment said the use of the National Security Act (NSA) against Aminul Haq Islam was illegal and unconstitutional.

This decision is a clear message to the Indian government that misuse of a powerful law to silence opponents will not be tolerated. The Modi government kept opposition MLA Aminul Haq Islam in jail for months under the National Security Act. Finally, the Gauhati High Court threw this order into the trash, citing violation of fundamental rights.

It is a proven fact that the Modi government was using laws like preventive detention as a weapon to suppress dissent in the country.

Aminul Haq Islam was arrested on April 24, 2018, for addressing a political rally. In this rally, he had called the false flag operation in Pahalgam on April 22 a conspiracy by the Modi BJP government to get votes.

Aminul Haq Islam was arrested under BNS Section 152 for exposing an Indian conspiracy, which deals with charges such as endangering the sovereignty, unity and integrity of India.

An elected public representative was first arrested for his speech, then granted bail and on the same day he was arrested again under the draconian National Security Act 1980.

Aminul Haq Islam\u2019s re-arrest came when there was no new crime against him. This move shows that the NSA is being used as a weapon to suppress dissent in the Hindutva system of the Modi government.

The High Court has declared Aminul Haq Islam\u2019s arrest under the NSA null and void, saying that the Indian authorities have violated his constitutional right.

According to legal experts, the arrest of Aminul Haq Islam and the charges against him are clear evidence of state vendetta. This was an act of state vengeance and a clear attempt to silence a voice of dissent ahead of the Bihar elections.

The incident sets a dangerous precedent for Modi\u2019s Hindutva rule in India.
