Medical reports, forensic findings and CCTV footage from inside the JIC substantiate the allegations. CCTV visuals from February 26 show the constable limping in pain, an image that prosecutors said starkly confirms the torment inflicted during illegal custody.

Those denied bail include DySP Aijaz Ahmad Naik, Sub Inspector Reyaz Ahmad Mir, Special Police Officer Jahangeer Ahmad, Head Constables Muhammad Younis Khan and Tanveer Ahmad Malla, Sergeant Constables Shakir Hussain Khoja and Altaf Hussain Bhat, and Constable Shahnawaz Ahmad Deedad. The charges against them include criminal conspiracy, wrongful confinement, causing hurt and grievous hurt, and using force to extract a confession.

The prosecution argued that the charged officers—who were themselves entrusted with upholding the law—grossly violated public trust and could influence witnesses if released. The court rejected the defence plea that absence of prosecution sanction or alteration of charges warranted bail, noting that the chargesheet was filed within the statutory period and that no circumstances justify release at this stage.

Human rights observers say the constable’s ordeal is only one documented case that surfaced because the victim belonged to the police force, adding that thousands of ordinary Kashmiris have suffered far worse without ever receiving justice. They maintain that custodial torture, arbitrary detention and forced confessions remain systemic tools of repression in IIOJK, with countless victims unheard and unrecorded.

Kashmiris fear that unless accountability mechanisms are enforced internationally, cases like this will continue to surface—each reflecting the iceberg of violence that lies beneath India’s militarised rule in the occupied territory.

Srinagar: In Indian illegally occupied Jammu and Kashmir, a court in Kupwara district has denied bail to eight policemen, including a Deputy Superintendent of Police, in a horrific custodial torture case that rights activists say represents only a fraction of the widespread abuses committed with impunity in the territory.
