Jammu : In Jammu, Indian illegally occupied Jammu and Kashmir, the Indian TADA court has dismissed an application filed by illegally detained Jammu and Kashmir Liberation Front Chairman, Muhammad Yasin Malik, seeking prior intimation of prosecution witnesses in a fake case registered against him by Indian agencies.<\/p>\n
According to Kashmir Media Service, the court rejected Malik\u2019s plea seeking five days\u2019 advance notice of prosecution witnesses in the fake 1990 IAF personnel killing case. The 3rd Additional Sessions Judge, Jammu, designated as Special Judge under TADA and the NIA Act, dismissed the application in CBI vs Mohammad Yasin Malik and others, arising out of an FIR registered under several black laws.<\/p>\n
The defence had argued that without prior information about the witnesses in the 36-year-old case, the jailed Yasin Malik was deprived of a fair opportunity to prepare for effective cross-examination.<\/p>\n
However, the court, justifying its order, claimed that although witness names are generally indicated in ordinary sessions trials, directing the prosecution to give advance intimation would not be free from risk to witnesses and would run contrary to the object of the law. The court further observed that the case is 36 years old and the advocates as well as parties are well aware of the case and the role of each witness.<\/p>\n
It directed the defence counsel to cross-examine the witnesses present in court, failing which the right to cross-examine would be deemed closed. Accordingly, the application was dismissed by the TADA court as being without merit. KMS-10R<\/p>\n","protected":false},"excerpt":{"rendered":"
