Bhubaneswar: In yet another case highlighting the prolonged incarceration of Muslims under black laws in Modi\u2019s India, a court in the BJP-ruled Odisha state has acquitted a Muslim man after more than a decade of imprisonment, ruling that there was no credible evidence linking him to any terrorist activity or banned organisation.<\/p>\n
According to Kashmir Media Service, the court of Sessions Judge Manas Ranjan Barik in Cuttack ruled that there was an \u201cabsolute dearth of material\u201d to prove Muhammad Abdur Rahman\u2019s alleged involvement in any terrorist act or association with outfits such as Al-Qaeda in the Indian Subcontinent (AQIS) or Indian Mujahideen (IM).<\/p>\n
Rahman, a resident of Paschimkachha village under Jagatpur police station in Cuttack district, was arrested in December 2015 by a joint team of Delhi and Odisha Police on allegations of radicalising youth and recruiting them for extremist activities.<\/p>\n
However, during the trial, the investigating officer admitted in cross-examination that no evidence was found to show that any student from the madrasa run by Rahman had joined any banned outfit.<\/p>\n
The officer further conceded that no arms, ammunition, or any material establishing his alleged links with terrorist organisations were recovered during the investigation.<\/p>\n
The court also noted that the prosecution failed to show any instance where Rahman had encouraged students or members of the community to join any banned group.<\/p>\n
Rejecting the charges under the draconian Unlawful Activities (Prevention) Act (UAPA), the court ruled that the prosecution had failed to establish any involvement in terrorist acts or unlawful association. It also dismissed the sedition charge under the Indian Penal Code, observing that no evidence was produced to prove incitement against the state.<\/p>\n
