Srinagar: In Indian illegally occupied Jammu and Kashmir (IIOJK), the High Court of has quashed the detention orders of three Kashmiris under the draconian Public Safety Act (PSA), ruling that the detentions were based on vague grounds and violated constitutional safeguards.<\/p>\n
According to Kashmir Media Service, the High Court directed the release of Uzair Amin Jan of Srinagar, Arif Ahmad Malla of Baramulla and Owais Mushtaq Ganie of Pulwama, unless they were required in any other case.<\/p>\n
Justice Sanjay Dhar, while quashing the detention orders of Uzair Amin Jan and Arif Ahmad Malla, observed that the grounds of detention were vague and lacked material particulars, depriving the detainees of their constitutional right to make an effective representation. The court held that the detention orders violated the safeguards guaranteed under Article 22(5) of the Indian Constitution and were therefore illegal and unsustainable.<\/p>\n
In a separate judgment, Justice Moksha Kazmi quashed the detention order of Owais Mushtaq Ganie, observing that no specific subversive activity had been attributed to him after he was granted bail by the Juvenile Justice Board in January 2025. The court said the authorities had failed to produce any material to justify his continued preventive detention under the PSA.<\/p>\n
Kashmir watchers said the ruling once again exposed the arbitrary use of the PSA to detain Kashmiris without trial. They said courts have repeatedly struck down such detention orders, highlighting the misuse of the draconian law to suppress dissent and curtail the fundamental rights of Kashmiris.<\/p>\n","protected":false},"excerpt":{"rendered":"
