Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir has quashed the detention of a Kashmiri man under the draconian Public Safety Act (PSA), holding that vague grounds of detention had deprived him of an effective opportunity to challenge his imprisonment.<\/p>\n
The court ordered the immediate release of Mashooq Ahmad Shah, a resident of south Kashmir\u2019s Shopian district, from detention, unless he was required in connection with any other case.<\/p>\n
A bench headed by Justice Rajnesh Oswal quashed the detention order issued by the District Magistrate Shopian on December 23, 2025. The court found that the vagueness in the grounds of detention violated the constitutional guarantee under Article 22(5), which provides a detainee the right to make an effective representation against preventive detention.<\/p>\n
The court observed that vague grounds strike at the root of the subjective satisfaction of the detaining authority and consequently vitiate the detention order. The ruling highlights how Kashmiri civilians can be held under the PSA on grounds too unclear to allow them to properly defend themselves against the allegations.<\/p>\n
The court also took serious note of the unexplained delay in considering Shah\u2019s representation against his detention. His representation was received by the authorities on January 14, 2026, but was not decided until March 2, 2026 \u2014 a delay of more than one and a half months.<\/p>\n
The court noted that Section 13 of the Public Safety Act requires the grounds of detention to be communicated within the prescribed period and guarantees the detainee an earliest opportunity to make a representation. Such representation, it stressed, must therefore be considered without undue delay.<\/p>\n
The court held that the unexplained delay further rendered Shah\u2019s detention illegal and ordered the authorities to release him forthwith.<\/p>\n
The judgment once again exposes concerns over the arbitrary use of the PSA in Indian illegally occupied Jammu and Kashmir, where Kashmiri youth and political activists have frequently been subjected to prolonged detention without ordinary criminal trials.<\/p>\n
The quashing of Shah\u2019s detention by the High Court demonstrates how detention orders based on vague allegations and procedural violations can deprive civilians of their fundamental rights and keep them behind bars without effective judicial scrutiny.<\/p>\n","protected":false},"excerpt":{"rendered":"
