IIOJK HC quashes Shopian man’s PSA detention over unsubstantiated allegations
Srinagar: In Indian illegally occupied Jammu and Kashmir (IIOJK), the High Court has quashed the detention of a Shopian resident under the draconian Public Safety Act (PSA), observing that the order appeared to be based on vague, unverifiable and unsubstantiated allegations.
According to Kashmir Media Service, a division bench comprising Acting Chief Justice Sanjeev Kumar and Justice Muhammad Yousuf Wani quashed the detention of Ubaid Yousuf Kuttay while allowing his appeal against a Single Judge’s November 8, 2025 decision that had dismissed his plea.
Kuttay was detained in September, 2024 under an order issued by the District Magistrate, Shopian, under the PSA on the alleged ground of “security of the State.”
After examining the facts and legal aspects of the case, the division bench allowed Kuttay’s appeal and set aside the Single Bench’s judgment.
The bench observed that the impugned detention order appeared to have been passed on “vague, unverifiable and bald allegations” unsupported by any evidence or material.
Quashing the detention order, the court directed that Kuttay be released from preventive detention.
