IIOJK High Court quashes PSA detention of Kashmiri over vague grounds, rejects pleas of four others
Srinagar: In Indian illegally occupied Jammu and Kashmir (IIOJK), the High Court has quashed the detention of a Kashmiri under the draconian Public Safety Act (PSA) and ordered the authorities to release him.
According to Kashmir Media Service, the High Court quashed the PSA detention of Muhammad Asif Sheikh, observing that the grounds cited for his detention under the law were extremely vague and unclear.
“The grounds must not be vague, indefinite or general. Vague allegations make it impossible for the detainee to understand the reasons and effectively challenge the detention”, the court said while quashing Sheikh’s PSA.
Meanwhile, a single-judge bench comprising Justice Sanjay Dhar dismissed the pleas filed by four other Kashmiris—Tasaduq Hussain Dar, Shabir Ahmad Ganie, Basit Ahmad Mir and Athar Mushtaq Khan—challenging their detention under the PSA.
It is pertinent to mention that the occupation authorities have detained more than 3,000 Kashmiris, including Hurriyat leaders and activists, under draconian laws such as the Public Safety Act and the Unlawful Activities (Prevention) Act (UAPA).
