IIOJK High Court annuls PSA detention orders against two Kashmiris

Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir (IIOJK) has quashed the detention orders under the draconian Public Safety Act (PSA) against two Kashmiri detainees.

According to Kashmir Media Service, the court, in separate rulings on the detainees’ petitions, annulled the detention orders against Shahid Shafi Sheikh and Muhammad Latief Dar, both residents of Srinagar. Justice Sanjay Dhar, who presided over the case, directed the occupation authorities to release the detainees immediately, provided they were not required in connection with any other legal matter.

Sheikh was detained under the PSA in Srinagar on August 30, 2022, while Dar had been placed under preventive detention on August 19, 2019.

The court noted that a detainee cannot effectively exercise their constitutional right to make a representation unless the material used to justify their detention is made available to them. The failure of the authorities to provide this material rendered the detention orders unlawful and invalid, it added. Consequently, the court quashed the detention orders against both Sheikh and Dar, ordering their release if they were not wanted in any other case.
