Jammu: NIA court rejects bail plea of Kashmiri detained for over six years
Irfan Shafi Mir remains behind bars in fabricated UAPA case
Jammu: In Indian illegally occupied Jammu and Kashmir (IIOJK), a Special National Investigation Agency (NIA) Court in Jammu has rejected the bail application of Kashmiri detainee, Irfan Shafi Mir, who has been imprisoned for more than six years in a fabricated case under the draconian Unlawful Activities (Prevention) Act (UAPA).
According to Kashmir Media Service, Special Judge NIA Cases Prem Sagar dismissed the plea, ruling that prolonged incarceration alone could not justify bail.
Irfan Shafi Mir has been accused of involvement in activities against India and maintaining links with a militant organization. Advocate Haroon Khursheed represented him before the court.
Seeking bail, the defence argued that Mir had remained in judicial custody for more than six years while the trial continued at a slow pace, contending that his prolonged detention violated his fundamental right to speedy justice under Article 21 of the Indian Constitution.
The defence further submitted that the prosecution had so far failed to produce sufficient incriminating evidence against Mir and that there was no risk of his absconding, influencing witnesses or tampering with evidence if released on bail.
However, the court rejected the argument and dismissed the bail application.
