IIOJK High Court quashes PSA detention of Baramulla resident

Srinagar: In Indian illegally occupied Jammu and Kashmir (IIOJK), the High Court has quashed the detention of a Baramulla resident under the draconian Public Safety Act (PSA) and ordered his release, observing that the detention order was based on weak grounds.

According to Kashmir Media Service, a single-judge bench comprising Justice Moksha Khajuria Kazmi quashed the PSA detention of 49-year-old Tariq Ahmad, a resident of Kralpora area of Baramulla district. The court passed the order on September 3 on a habeas corpus petition filed by Ahmad’s sister.

The petition challenged the detention order dated April 12, 2024, issued by the District Magistrate, Baramulla, under which Ahmad was placed under preventive detention.

The petition contended that Ahmad had been detained on vague, irrelevant and non-existing grounds and had not been furnished all the material relied upon by the detaining authority while passing the detention order.

The High Court, after examining the matter, found that the grounds relied upon for Ahmad’s detention were weak and could not sustain the preventive detention order.

Quashing the detention order, the court directed the authorities to release Tariq Ahmad forthwith if he was not required in connection with any other case.
