IIOJK HC quashes PSA detention over illegal grounds

Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir has quashed the preventive detention of a 35-year-old Bijbehara resident under the draconian Public Safety Act (PSA), ruling that inordinate and unexplained delay in considering a detainee’s representation renders detention illegal.
According to Kashmir Media Service, a bench of Justice M. A. Chowdhary set aside the detention order against Tariq Ahmad Rah, 35, of Gundnowroz, Bijbehara in Islamabad district. The court held that Constitution obligates the government to consider a detainee’s representation at the earliest. “There should be no slackness, indifference and callous attitude in consideration of the representation of a person who is detained,” the court said, adding that “every day delay in dealing with the representation has to be explained.”
The PSA order, issued on May 16, 2025 under Public Safety Act, was based on two FIRs at Bijbehara Police Station involving cheating allegations. The court found no substantive material showing activities prejudicial to public order.
Quashing the detention, the High Court directed that Rah be released forthwith. KMS-12K
