Delhi HC tribunal confirms ban imposed on IIOJK Jamaat-e-Islami

New Delhi: A Delhi High Court tribunal has validated the ban imposed on Jamaat-e-Islami, Jammu and Kashmir for its involvement in pro-freedom activities in Indian illegally occupied Jammu and Kashmir.

According to Kashmir Media Service, the Indian court described and claimed it prejudicial to internal security and public order, having the potential to disrupt the unity and integrity of India.

While declaring the socio-religion-political party outlawed, the Indian home ministry had listed 47 cases registered against it. They included an NIA case for collection of funds and encouragement to demand plebiscite and freedom from Indian occupation activities.

Another NIA case was registered against the members and cadres of the Jamaat-e-lslami, including Ameer Mohammad Shamsi, chief executive of Al-Huda Educational Trust (AHET), for receiving funds through AHET, Rajouri, in the name of Jamaat-e-lslami even after its ban in February, 2019. AHET was formed by the top leadership of Jamaat-e-lslami, including Ameer Mohammed Shamsi. They were the trustees of AHET.

The Indian home ministry also claimed the Jamaat-e-lslami is in close touch with pro-resistance parties and is continuously supporting freedom from Indian struggle in J&K and elsewhere.

According to the home ministry, the Jamaat-e-lslami Jammu and Kashmir is supporting freedom from India and is involved in anti-India and other activities intended to cause disaffection, it claimed.

However, the tribunal, consisting of Justice Navin Chawla, Judge, High Court of Delhi, concluded that there is ample justification to declare Jamaat-e-lslami J&K as an unlawful association vide notification dated February 27.

Earlier, Jamaat-e-Islami IIOJK was banned by Bharatiya Janata Party Indian government on February 28, 2019 for a period of five years which was subsequently extended on February 28, 2024 for further five years.
