IIOJK HC slams ‘shameless’ PSA detention of Kashmiri man, orders immediate release

Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir has quashed the draconian Public Safety Act (PSA) detention of a Kashmiri man, Imtiyaz Ahmad Ganie of Islamabad, slamming the authorities for wrongful detention and terming the action an act of “shamelessness”.
According to Kashmir Media Service, the court ruled that the detention order, issued by the District Magistrate Islamabad, was based on mistaken identity and lacked any legal justification. It directed Ganie’s immediate release from custody.
Justice Moksha Kazmi observed that the authorities had “shamelessly” relied on irrelevant material to implicate Ganie. “The foundation on the basis whereof the detainee has been implicated and detained under preventive detention has collapsed by default,” the court said.
Highlighting the gross misuse of law, the court noted that Ganie had no connection with the criminal case cited in the detention order, which actually pertained to another person with a similar name. It termed the episode a glaring example of “non-application of mind” by the detaining authority.
The judgment vindicated the arguments of Ganie’s counsel, who proved that his client was wrongly booked under the draconian PSA.
