Civic space shrinking in IIOJK after August 2019 changes: IMWU at UNHRC

Geneva: At the 61st session of the United Nations Human Rights Council, the International Muslim Women’s Union (IMWU) has expressed serious concern over the shrinking civic space in Indian illegally occupied Jammu and Kashmir, stating that fundamental rights are being systematically curtailed following the constitutional changes of August 2019.

According to Kashmir Media Service, speaking during the General Debate under Agenda Item 4, IMWU representative Sobia Shawl emphasized that civic space — including freedom of expression, assembly, association, and political participation — is a fundamental right protected under international law, not a privilege granted by governments.

She highlighted that in recent years, the situation in IIOJK has undergone a dramatic transformation marked by extended internet shutdowns, preventive detentions of political leaders and youth, increased surveillance of journalists and civil society organizations, and restrictions on peaceful assembly and protest.

Sobia Shawl noted that frequent internet disruptions have severely affected communication, education, healthcare access, and economic activity in the territory. She said when internet access becomes uncertain, freedom of expression is weakened, and when assembly is restricted, democratic processes are undermined.

She further pointed out that the digital space, once a source of empowerment for Kashmiri youth, has increasingly come under strict monitoring and regulation. In the modern era, she said, connectivity is essential for education, commerce, and free thought, and prolonged shutdowns amount to a serious disruption of human development.

Highlighting the daily impact of these restrictions, she said students are unable to attend online classes, journalists face fear of legal repercussions for reporting, small business owners suffer due to disrupted digital commerce, and families remain cut off from their loved ones during communication blackouts.

The IMWU urged the international community to take notice of the situation and ensure the protection of fundamental freedoms in IIOJK in accordance with international human rights standards. KMS-1K
