Indian Union Muslim League moves top court seeking stay on CAA
New Delhi: The Indian Union Muslim League (IUML) has filed an application before the Supreme Court requesting a stay on the implementation of the rules notified by the Indian Home Ministry under the controversial Citizenship Amendment Act (CAA).
According to the Kashmir Media Service, IUML, in its application, stated that the Citizenship Amendment Rules, 2024, are manifestly arbitrary and confer an unfair advantage upon a specific class of individuals solely based on their religious identity, which contravenes Articles 14 and 15 of the Constitution.
The application highlighted that approximately 250 petitions challenging the provisions of the CAA are pending before the apex court. In the event that the CAA is deemed unconstitutional, it would create an “anomalous situation” where individuals who would have obtained citizenship under the impugned Act and Rules might face the revocation of their citizenship.
“Therefore, it is in the best interest of every individual to defer the implementation of the CAA and impugned rules until the Hon’ble Court reaches a final decision on the matter. The Petitioner has sought a stay on the implementation of the provisions of the impugned act. The Writ Petition has been pending for the last 4.5 years,” the application stated.
The Citizenship Amendment Act (CAA), 2019, grants citizenship to non-Muslim migrants who arrived from Pakistan, Bangladesh, and Afghanistan on or before December 31, 2014.
