IIOJK High Court quashes detention of innocent Kashmiri booked under draconian PSA

Srinagar: The Indian illegally occupied Jammu and Kashmir High Court has quashed a detention under black law, Public Safety Act (PSA) of a person from Srinagar, ruling that the grounds of detention were based on mere suspicions and conjectures.

According to Kashmir Media Service, the court’s ruling came in response to a habeas corpus petition filed by Jehangir Ahmad Mir, challenging his detention ordered by the District Magistrate, Srinagar, in June 2022.

The court delivered the verdict, underscoring the necessity for specific and fact-based grounds for detention.

Mir’s detention was predicated on a fake case, as outlined in a dossier prepared by the Senior Superintendent of Police (SSP) of Srinagar. However, the court found the grounds of detention lacking in factual details, pointing out that the police authorities failed to provide case against Mir.

Consequently, the IIOJK High Court ordered Mir’s immediate release and directed the authorities in Srinagar to ensure his safe release from custody.
