IIOJK court nullifies PSA detention of three Kashmiri men

Srinagar: Indian illegally occupied Jammu and Kashmir High Court has revoked the detention of three Kashmiris who were held under the Public Safety Act (PSA), a law ruthlessly executed, as evident from the case in point, in the territory against pro-freedom people.

According to Kashmir Media Service, a bench headed by Justice Rahul Bharti invalidated the detention order against Umar Nazir Rather from Tral, which was issued by the District Magistrate Pulwama last year.

The dossier against Rather alleged his involvement, along with others, in enticing students and their parents to obtain leaked question papers for an examination of B.Sc Nursing Course admission, conducted by the Board of Professional Entrance Examination (BoPEE), in exchange for large sums of money.

The court ruled that the preventive detention of the petitioner was unwarranted, as the alleged actions attributed to him were not deemed detrimental to public order. Consequently, the detention order dated June 26, 2023, passed by the District Magistrate, Pulwama, was set aside, and the petitioner was ordered to be released.

In similar decisions, Justice Puneet Gupta’s bench annulled the PSA detention of Ajaz Ahmed Peer from Baramulla and Inayat Rashid Bhat from Ganderbal. The court instructed the immediate release of the detainees if not required in any other case. Peer was detained by the Deputy Commissioner Baramulla on September 15, 2022, while Bhat was held by an order from the District Magistrate Ganderbal on June 25, 2022.
