The unresolved Kashmir dispute continues to evoke diverse perspectives among Kashmiris. Some hold Pakistan responsible, others blame India, while some believe that Kashmiri leadership itself has played a role in prolonging the conflict.

However, this is a complex issue, and it is incorrect to hold Pakistan and India equally responsible for the lack of resolution. There are strong reasons supporting this argument.

The political and constitutional status of Azad Jammu & Kashmir (AJK) under Pakistan’s administration underscores Pakistan’s commitment to the right of self-determination for the people of Jammu & Kashmir. Unlike India, which has unilaterally annexed Occupied Jammu & Kashmir through constitutional amendments, Pakistan has upheld international law and UN resolutions by maintaining AJK as a self-governing entity.

AJK enjoys a distinct political and constitutional identity within Pakistan’s framework, with:

Its own President, Prime Minister, and Legislative Assembly, ensuring independent governance.

A separate Constitution defining its governance structure and legal framework.

Its own flag, symbolizing its unique status.

An independent judiciary, ensuring the rule of law.

This arrangement highlights Pakistan’s adherence to UN Security Council Resolutions, which recognize Kashmir as a disputed territory awaiting a plebiscite under UN supervision.

Pakistan’s Legal and Diplomatic Position

Article 257 of the Constitution of Pakistan explicitly states that the final status of Jammu & Kashmir, including AJK, will be determined through a UN-mandated plebiscite. This provision reinforces Pakistan’s legal and diplomatic stance that Kashmir’s future must be decided by its people, as per international commitments.

India’s Violation of International Commitments

On the other hand, India’s unilateral revocation of Articles 370 and 35A in August 2019 directly violated UN resolutions and bilateral agreements such as the Simla Agreement (1972). By fully integrating Occupied Jammu & Kashmir into the Indian Union and stripping it of its previous special status, India has:

Breached its commitments to the UN and the international community.

Increased regional instability by suppressing Kashmiri aspirations through military force.

Pakistan’s Strengthened Case on the International Stage

By maintaining AJK’s autonomous governance, Pakistan has reinforced its diplomatic position in multiple ways:

1. Legitimacy in International Law – Pakistan’s adherence to UN resolutions provides it with moral and legal standing in advocating for Kashmir’s self-determination.

2. Contrast with India’s Actions – While India has imposed direct rule, Pakistan’s recognition of AJK’s autonomy highlights its democratic and legal approach.

3. Stronger Diplomatic Leverage – Pakistan’s position aligns with international norms, increasing global pressure on India to engage in meaningful dialogue.

Pakistan’s policy toward AJK reflects its respect for Kashmiri aspirations and international law. By allowing AJK to function as a self-governing entity, Pakistan presents a stronger case on the international stage, reinforcing its stance that the Kashmir dispute must be resolved through a free and fair plebiscite—something India has repeatedly violated.
