IIOJK HC quashes detention of two youth booked under draconian PSA
Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir has quashed illegal detention of two youth booked under black law Public Safety Act and ordered their release.
According to Kashmir Media Service, a bench of Justice Rajesh Sekhri quashed detention order dated 15 September 2022, passed by District Magistrate Baramulla against Tariq Ahmad Napa.
The court said that due to vagueness of allegations the detention order does not sustain in the eyes of law, adding, “As a result, detainee, namely, Tariq Ahmad Napa is directed to be released from the custody”.
Meanwhile, Justice MA Chowdhary quashed detention order passed by district Magistrate Srinagar on 27 June 2022 by virtue of which Suhail Ahmad Shah was ordered to be detained and lodged in Central Jail, Jammu.
He said that the detention order was based on vague grounds and the only purpose was to curtail the cherished right of liberty of the detainee. Subsequently, the court quashed the detention order and directed authorities including Jail Superintendent concerned, to release Shah.
