IIOJK High Court quashes PSA detentions of three Kashmiris

Srinagar: The High Court of Indian illegally occupied Jammu and Kashmir has ordered the immediate release of three Kashmiris, quashing their detention under the black law Public Safety Act (PSA).

According to Kashmir Media Service, a bench led by Justice Moksha Khajuria Kazmi annulled the detention order dated July 13, 2024, issued by the District Magistrate of Srinagar against Advocate Mian Muzaffer of Barzulla, Srinagar. The court observed that the grounds cited for the detention were vague and lacking clarity, with no clear connection between the detainee’s past conduct and the necessity of his detention. The judgment stressed that the reasons provided were not only vague but also lacked a direct and urgent link to the detainee’s actions.

In a separate ruling, a bench headed by Justice Sanjay Dhar granted relief to two other detainees, Javaid Ahmad Beigh and Zahid Nisar Hajam, by quashing their respective detention orders issued by the District Magistrate of Shopian. Beigh had been detained on January 24, 2023, while Hajam’s detention was based on an order from July 17, 2023.

The detainees were granted immediate release, with the court directing that they be freed unless required in other cases.
